TUB: sogno o realtà?

Mentre Torino e Milano si confrontano ad armi sguainate per essere designate ciascuna come sede Italiana del nuovo Tribunale Unificato dei Brevetti, occorre fare il punto sulla situazione in cui si trova oggi il sistema brevettuale unico.

Come noto, il nuovo sistema di tutela brevettuale unitaria ha posto la necessità di creare un tribunale ad hoc, ossia il Tribunale Unificato dei Brevetti (TUB), con competenza esclusiva per la risoluzione delle controversie in materia di brevetti europei e di brevetti europei con effetto unitario (più semplicemente, “brevetto unitario”) mediante la sottoscrizione dell’Accordo istitutivo del Tribunale Unificato dei Brevetti in data 27 febbraio 2013.

To that effect, new “digitalized” hearings and other alternative means (i.e. the filing of written notes with the Court a few days before the hrearing) have been introduced in place of physical hearings.

What might happen if this should be the case?

Let’s consider for a moment how Italian national rules are set to balance the fundaments rights at stake (on the one hand, the exclusive rights of IP owners and, on the other hand, the public health and security of citizens), as well as foster the research and technical process for the treatment of the Covid-19 disease.
